RMA'd my SSD to these guys as it was only producing 40mbps read and less then 10mbps write, causing windows 7 to stutter alot and basically the speeds are far too low, tried it on my pc, my bros pc and my dads all the same performance.

The ssd in question is a corsair nova series 2 60gb drive and the corsair forums are littered with people having similar problems.

Now scan have rang me after 3 weeks of having my drive and said there is no fault with the drive and it works as it should.... I used 3 different pcs all with different motherboards and tried numerous sata cables...

I explained the speed issue and they have stated they got 260+ read and around 220-230 write, they couldnt tell what what mobo or rig was used to test as i have used am3, s775 and lga 1366

I now have to pay £35 + vat to get my drive back as i "returned a working item" the drive was only £62 with VAT!

Feel like im being screwed over here!

i actually bought one on the 30th July and that was dead on arrival so sent it back within 2/3 days of receiving.

The replacement came on August the 30th and returned that for poor performance on the 2nd of September.

They only just got back in touch with me to ask for £35 + VAT to return the item as its fine, it was clearly not fine and why should i have to pay nearly the amount for the SSD to get back the item!

In that case you can probably argue the right to cancel the contract as you returned the item within 7 days.
Another point worth noting is they have to prove that the item isn't faulty/fit for purpose - So for them not to tell you what system they've "tested" it on isn't right, in fact they should probably test it on the exact same setups as you have...

The main point is you're allowed to return a "working item" within 7 days (within a month if they didnt send you written terms of return) - they have to give you a full refund - possibly even pay the cost of returning the item.

If they say you returned it as faulty, not as a change of mind, tell them you changed your mind because you thought it was faulty........

Ring first quoting the distance selling regulations (DSR) an email is as good as a letter too - always a good idea to CC: watchdog@bbc.co.uk

A point worth noting and something I've only just thought of is that it would be in the shops interest to send you a working version and try to charge you for it as "not faulty".....

the reason I (as a retailer) hate the DSR's is because as soon as anyone decides that they don't want something, it immediately costs the retailer money (firstly due to the postage costs they have to give back)

I'd go with "It's ok, you can keep it, I'll just take a refund" - and that's a full refund inc postage.

ok update, they are refusing a refund and will only send back my item at a "reduced" cost of £25 to cover postage back to me and testing fees.

I told them that if they cant send a full refund ill be happy to take a different SSD, nope must be the one i sent to them, so i told them to forget that idea then and just a refund.

Bugger best get writing emails i feel

Go with full refund under distance selling regulations - You sent the item back to them both times in less than 7 days. Bit tricky really.
You could ask them to tell you how they proved it wasn't faulty - You could probably reject their explanation (especially if they're being sketchy) and go back to demanding money back under DSR.....
Ask them who would be the best name to pass forward to Watchdog ;)
