Here in Denmark it's allowed for the reseller to destroy the item if the consumer dont want it back and the item has been waiting for more than 3 months for the consumer to pick it up/return.

A lot of the rules are the same so you probably have that rule in UK as well.

If the drive is less than 6 months old the reseller has to prove that the item is faulty (not you who has to prove anything).

Ask them to send proof that the drive infact work incase they haven't already done that. And tell them they are not allowed to dispose of the product yet as you have contacted Corsair and are waiting for their reply.

The law here makes it up to the consumer to choose if he want to go direct to the company that produced the product (Corsair) or the reseller that sold it. Your rules are most likely the same. Since you already chose Scan you can't really force Corsair to test it. BUT If I was you I would write Corsair today and explain that you have already tested the the drive on three different motherboards and that you feel Scan is trying to scam you. Ask them if they have had any SSD's returned with that kind of fault on SSD drives before and if they can assist you on the matter since you are sure the drive is faulty.

In any case where it is established that there was no defect in the goods at the point of delivery to you

I tested the device on three different motherboards, a s775, lga1366 and a am2+ board, all worked with an ocz agility 2 ssd with good speeds (200+mbps). This drive gave readings of under 50mbps for write and under 20mbps for read on ALL boards the same results.

I have sought advice from corsair themselves and on their own community forum where many people have similar issues with the Nova2 series.

I don't feel i am asking too much to have the working drive sent to me, im not asking for a refund, im not asking for anything in excess to what im entitled too. I paid for a working drive and thats all i want.
